1. Eligibility & Account Registration

• You must be at least 18 years old and have the legal authority to enter into a binding contract to use the Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate, current, and complete information at registration and keep it updated.

2. Description of Services

LogiPod provides courier aggregation, logistics, transportation, warehousing, and related technology-enabled services, connecting Users with third-party courier and logistics partners for the pickup, transportation, and delivery of shipments. Service availability, delivery timelines, and pricing may vary by location, shipment type, and partner network, and are provided on a reasonable-efforts basis.

3. User Responsibilities

• Provide accurate shipment details, including weight, dimensions, declared value, and contents
• Ensure shipments comply with applicable laws, customs regulations, and courier partner policies
• Package shipments adequately to withstand normal handling and transit
• Not ship prohibited, restricted, hazardous, or illegal items, including but not limited to firearms, narcotics, explosives, and counterfeit goods
• Use the Services only for lawful business or personal purposes

LogiPod reserves the right to inspect, refuse, hold, or return any shipment that appears to violate these Terms or applicable law.

4. Pricing & Payments

• Shipping rates are calculated based on weight, dimensions, distance, service type, and applicable surcharges, and are displayed prior to booking
• Applicable taxes (including GST), duties, and fees must be paid as agreed between the Customer and LogiPod
• Payments may be collected upfront, on a wallet/prepaid basis, or through agreed credit terms for registered business accounts
• LogiPod reserves the right to charge weight or dimension discrepancy fees where the actual shipment differs from the declared details

5. Delivery, Delays & Failed Deliveries

Estimated delivery timelines are indicative and not guaranteed. LogiPod is not liable for delays caused by incorrect address information, recipient unavailability, customs clearance, courier partner network disruptions, weather, strikes, or other circumstances beyond our reasonable control. Repeated failed delivery attempts may result in a shipment being returned to the sender, subject to applicable return shipping charges.

6. Claims, Loss & Damage

Claims for lost, damaged, or delayed shipments must be reported to LogiPod within the time period specified in our claims policy, along with supporting documentation. Compensation, where applicable, is limited to the declared value of the shipment or the applicable courier partner's liability limit, whichever is lower, and excludes indirect or consequential loss.

7. Limitation of Liability

To the maximum extent permitted by law, LogiPod shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, business, or goodwill, arising from the use of the Services. LogiPod's total aggregate liability for any claim shall not exceed the amount paid by the Customer for the specific shipment or service giving rise to the claim.

8. Intellectual Property

All content on the LogiPod website and applications, including text, graphics, logos, software, and trademarks, is owned by or licensed to LogiPod Logistics Private Limited and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute such content without prior written consent.

9. Suspension & Termination

LogiPod may suspend or terminate your access to the Services, with or without notice, if these Terms are violated, if fraudulent or unlawful activity is suspected, or for non-payment of dues. You may close your account at any time by contacting support, subject to settlement of any outstanding obligations.

10. Indemnification

You agree to indemnify and hold LogiPod Logistics Private Limited, its officers, employees, and partners harmless from any claims, losses, or liabilities arising from your breach of these Terms, misuse of the Services, or violation of applicable law.

11. Force Majeure

LogiPod shall not be held responsible for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, pandemics, government action, strikes, or network and infrastructure failures.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

13. Amendments

LogiPod may revise these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
